도널드 트럼프 미국 대통령은 한국시간 10일 워싱턴DC 연방항소법원 브렛 캐버노 판사를 새 대법관 후보로 지명했다.
브렛 캐버노 판사는 워싱턴DC 출신으로 인근 메릴랜드 주에서 성장했다.

캐버노 판사는 예일대 학부를 거쳐 예일대 로스쿨을 졸업했다.

2006년 조지 W. 부시 전 대통령에 의해 연방 판사로 임용됐다.

부시 대통령 시절 백악관에서 법률 고문으로 근무하기도 했다.

1998년 빌 클린턴 전 대통령의 '섹스 스캔들'을 조사한 케네디 스타 특별검사팀의 보고서 초안을 작성하는 과정에도 참여한 적이 있다.

캐버노 판사는 상원 인준을 받으면 7월31일 스스로 은퇴하는 케네디 대법관의 자리를 잇게 된다.
대법관 지명자는 상원 법사위원회 청문회를 거쳐 상원 전체회의에서 의원 100명 중 과반수 찬성을 얻어야 정식으로 임명된다.

상원의 의석분포는 공화당 51석, 민주당과 무소속이 49석이다.

공화당에서 이탈표가 나오지 않는다면 여당 지지만으로도 인준안이 통과될 수 있다.

케네디 대법관 대신 캐버노 판사가 합류하면 미국 연방대법원은 보수 5명, 진보 4명으로 이념의 무게 추가 오른쪽으로 기울 전망이다.

1988년 지명된 케네디 대법관은 중도 보수 성향이지만 찬반 의견이 팽팽히 갈렸던 주요 사안에서 캐스팅보트를 행사하며 대법원의 균형추 역할을 해왔다.

케네디 대법관이 빠지면서 연방대법원은 존 로버트 대법원장과 새뮤얼 앨리토, 클래런스 토머스, 닐 고서치 대법관 등 보수 4명과 루스 베이더 긴즈버그, 스티븐 브라이어, 소니아 소토마요르, 엘리나 케이건 대법관 등 진보 4명의 구도가 되지만 캐버노 판사의 보수 가세로 다시 보수 5대 진보 4의 구도로 바뀐다.

Brett Michael Kavanaugh (born February 12, 1965) is a nominee to become an Associate Justice for the United States Supreme Court. He currently serves as a United States Circuit Judge of the United States Court of Appeals for the District of Columbia Circuit. He was White House Staff Secretary during the Presidency of George W. Bush.

A protégé of Ken Starr, Kavanaugh played a lead role in drafting the Starr Report, which urged the impeachment of President Bill Clinton.

Kavanaugh led the investigation into the suicide of Clinton aide Vince Foster. After the 2000 U.S. presidential election, in which Kavanaugh worked for the George W. Bush campaign in the Florida recount, Kavanaugh joined Bush's staff, where he led the Administration's effort to identify and confirm judicial nominees.

Kavanaugh was nominated to the D.C. Appeals Court by Bush in 2003. His confirmation hearings were contentious and stalled for three years over charges of partisanship. Kavanaugh was ultimately confirmed in May 2006 after a series of negotiations between Democratic and Republican senators.

Kavanaugh was nominated by President Donald Trump on July 9, 2018, to become an Associate Justice of the Supreme Court of the United States, following the vacancy created by the pending retirement of Associate Justice Anthony Kennedy.
